Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Means a unique account created for You to access our Service or parts of our Service.

Business

For the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers' personal information, that does business in the State of California.

Company

Referred to as either "the Company," "We," "Us," or "Our" in this Agreement, refers to Centurion Solar Energy LLC (d/b/a Centurion Energy), 575 Fifth Ave, 14th Floor, New York, NY 10017.

Consumer

For the purpose of the CCPA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.

Cookies

Small files that are placed on Your computer, mobile device, or any other device by a website, containing the details of Your browsing history on that website among its many uses.

Country

Refers to: New York, United States.

Device

Any device that can access the Service, such as a computer, a cellphone, or a digital tablet.

Do Not Track (DNT)

A concept promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.

Personal Data

Any information that relates to an identified or identifiable individual. For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.

Sale

For the purpose of the CCPA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's personal information to another business or a third party for monetary or other valuable consideration.

Service

Refers to the Website.

Service Provider

Any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.

Third-party Social Media Service

Any website or any social network website through which a User can log in or create an account to use the Service.

Usage Data

Data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Refers to Centurion Energy, accessible from https://www.centurion-energy.com.

You

The individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Email address
  • First name and last name
  • Phone number
  • Address, State, Province, ZIP/Postal code, City

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile internet browser You use, unique device identifiers, and other diagnostic data.

  • With Affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners, or other companies that We control or that are under common control with Us.

Note: the sharing described above does not apply to mobile phone numbers collected for SMS opt-in purposes. SMS consent and mobile opt-in data are not shared with third parties or affiliates for any purpose. See "SMS Messaging Terms" below for how that data is handled.

SMS Messaging Terms

If You provide Us with Your mobile phone number and opt in to receive text messages, You agree to receive SMS messages from Centurion Energy related to appointment reminders, project and order status updates, account notifications, and customer service communications.

Messaging frequency may vary. Message and data rates may apply, depending on Your mobile carrier and plan.

You may opt out of receiving SMS messages from Us at any time by replying STOP to any message You receive. For assistance, reply HELP, or visit our website at www.centurion-energy.com.

SMS consent and mobile opt-in data are not shared with third parties or affiliates. Consent to receive SMS messages is not a condition of purchasing any goods or services from the Company.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. Business Transactions

CCPA Privacy (California Residents)

This privacy notice section for California residents supplements the information contained in Our Privacy Policy, and it applies solely to all visitors, users, and others who reside in the State of California.

Age, race, color, ancestry, national origin, citizenship, religion, marital status, medical condition, disability, sex, sexual orientation, veteran status, genetic information.

Records and history of products or services purchased or considered.

Category E: Biometric information (Collected: No)

Genetic, physiological, behavioral, and biological characteristics or activity patterns, such as fingerprints, faceprints, iris/retina scans, keystroke or gait patterns, sleep, health, or exercise data.

Category F: Internet or other network activity (Collected: Yes)

Interaction with our Service or advertisement.

Category G: Geolocation data (Collected: No)

Approximate physical location.

Category H: Sensory data (Collected: No)

Audio, electronic, visual, thermal, olfactory, or similar information.

Category I: Professional or employment-related information (Collected: No)

Current or past job history or performance evaluations.

Category J: Non-public education information (Collected: No)

Education records directly related to a student, maintained by an educational institution, such as grades, transcripts, or student ID codes.

Category K: Inferences from other personal information (Collected: No)

A profile reflecting preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

What's Excluded

Under CCPA, personal information does not include publicly available information from government records; deidentified or aggregated consumer information; or information excluded from the CCPA's scope, such as health information covered by HIPAA/CMIA, information covered by sector-specific laws like FCRA, GLBA, or FIPA, or information covered by the Driver's Privacy Protection Act of 1994.

Sources of Personal Information

We obtain the categories of personal information listed above from: directly from You (forms You complete, preferences You provide); indirectly from You (observing Your activity on our Service); automatically from You (cookies We or our Service Providers set as You navigate the Service); and from Service Providers or other third-party vendors We use to provide the Service.

Use for Business or Commercial Purposes

We may use or disclose personal information for business or commercial purposes, including: to operate and provide our Service; to support and respond to Your inquiries; to fulfill the reason You provided the information; to respond to law enforcement requests as required by law; for internal administrative and auditing purposes; and to detect security incidents and protect against malicious or fraudulent activity.

Disclosure for Business or Commercial Purposes

We may disclose the following categories of personal information for business or commercial purposes: Category A (Identifiers), Category B (California Customer Records), and Category F (Internet or network activity). When We disclose personal information for a business or commercial purpose, We enter a contract requiring the recipient to keep it confidential and use it only to perform that contract.

Sale of Personal Information

As defined in the CCPA, "sell" and "sale" mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a consumer's personal information to a third party for valuable consideration, monetary or otherwise. We may have shared Category A, B, and F information for value in the last twelve months.

Share of Personal Information

We may share Your personal information with: Service Providers; Our affiliates; Our business partners; and third-party vendors to whom You or Your agents authorize Us to disclose Your personal information in connection with products or services We provide to You.

Minors Under 16

We do not sell the personal information of Consumers We actually know are less than 16 years of age, unless We receive affirmative authorization from either the Consumer (if 13–16) or a parent or guardian (if under 13). If You have reason to believe a child under 13 (or 16) has provided Us with personal information, please contact Us.

Your Rights Under the CCPA

If You are a California resident, You have: the right to notice of what's collected and why; the right to request disclosure of the categories and specifics of information collected, sold, or disclosed; the right to opt out of the sale of Your personal information; the right to request deletion, subject to certain legal exceptions; and the right not to be discriminated against for exercising any of these rights.

Exercising Your CCPA Rights

Only You, or an authorized representative registered with the California Secretary of State, may make a verifiable request. We will respond within 45 days of a verifiable request, with one 45-day extension available where reasonably necessary. Disclosures cover only the 12-month period preceding the request.

Do Not Sell My Personal Information

You have the right to opt out of the sale of Your personal information. Once We receive and confirm a verifiable request, We will stop selling Your personal information. To exercise this right, please contact Us.

"Do Not Track" Policy (CalOPPA)

Our Service does not respond to Do Not Track signals. Some third-party websites do keep track of Your browsing activities; You can set Your browser preferences to inform websites that You do not want to be tracked.

California Shine the Light Law

Under California Civil Code Section 1798, California residents with an established business relationship with Us can request information once a year about sharing their Personal Data with third parties for the third parties' direct marketing purposes. California Privacy Rights for Minor Users

California Business and Professions Code Section 22581 allows California residents under 18 who are registered users of online sites, services, or applications to request and obtain removal of content or information they have publicly posted. To request removal, contact Us using the information below and include the email address associated with Your account. This request does not guarantee complete removal in all circumstances.

We may update Our Privacy Policy from time to time.
